Welcome to EZLivingTrust.com (the “Website”) and our online document preparation platform (the “Service”). These Terms and Conditions (“Terms”) govern your access to and use of the Website and Service (collectively, the “Platform”).
EZ Living Trust is a DBA of Strategic Choices Financial, Inc. (“EZ Living Trust,” “we,” “our,” or “us”). By accessing or using the Platform, you (“you,” “your,” or “Client”) agree to these Terms. If you do not agree, do not use the Platform.
These Terms and Conditions (“Terms”) govern the relationship between EZ Living Trust and any licensed financial professional, affiliate, or approved participant (“Partner,” “you,” or “your”) who participates in the EZ Living Trust Partner Referral Program (the “Program”).
By applying to or participating in the Program, accessing your Partner Portal, or referring clients through a Partner subdomain, you agree to these Terms in full.
2.1 Independent Contractor Status
Partners are independent contractors and not employees, agents, representatives, or legal associates of EZ Living Trust or Strategic Choices Financial, Inc.
2.2 Referral Partnership Only
This Program establishes a referral relationship, not a joint venture, partnership, franchise, or employment relationship. Partners refer clients to EZ Living Trust for fulfillment. EZ Living Trust provides the platform, document creation process, and client service.
2.3 No Legal Advice
EZ Living Trust is a Legal Document Assistant service, not a law firm. Partners may not provide legal advice or represent themselves as legal professionals unless they are separately licensed to do so under state law.
2.4 No Authority to Bind
Partners may not make commitments, warranties, or representations on behalf of EZ Living Trust beyond what is explicitly provided in company-approved materials.
3.1 Client Ownership and Access
Partners may refer clients through a unique subdomain or referral link. Each client account belongs solely to the client.
3.2 Continuity of Accounts
If a Partner’s license expires, the Partner retires, or ends their participation in the Program, all referred client accounts remain active and accessible to the client through the EZ Living Trust platform for the life of the client or the system.
3.3 Partner Portal Access
Partners may view or assist clients through limited access to their accounts. Clients may rescind Partner access at any time.
3.4 Data Retention and Ownership
All data, work product, and client documents generated through the platform remain the sole property of EZ Living Trust. Partners are custodians only for service purposes and may not duplicate, export, or retain client data beyond their authorized use.
3.5 Portal Termination
EZ Living Trust may deactivate Partner subdomains, affiliate portals, or related access if the partnership ends or the Partner becomes inactive.
4.1 Professional Standards
Partners must act with honesty, integrity, and transparency. They may not engage in deceptive marketing or make unapproved claims regarding legal outcomes or services.
4.2 Compliance with Licensing Requirements
Partners must maintain valid licenses or certifications, where applicable, and comply with all state and federal regulations governing their practice.
4.3 Fee Arrangements
If Partners charge their own limited document assistance or consultation fees directly to clients, separate from EZ Living Trust’s flat-rate portal fee, such fees are not set or controlled by EZ Living Trust and must be clearly disclosed to clients.
5.1 Eligibility
Qualified Partners may apply for a Private Label version of the EZ Living Trust platform, which allows for custom branding and tiered pricing.
5.2 Approval and Pricing
Private Label status is granted at EZ Living Trust’s discretion and may depend on the Partner’s experience level, referral volume, and client satisfaction metrics. Pricing schedules and customization levels may vary.
5.3 Continuity of Client Accounts
Clients created under a Partner’s Private Label subdomain remain linked to EZ Living Trust’s platform and terms. EZ Living Trust retains all data ownership and service continuity rights.
6.1 Referral Relationship
Partners primarily refer clients to EZ Living Trust for document preparation services. EZ Living Trust serves these clients directly within its secure platform.
6.2 Referral and Override Fees
Partners may earn referral or override fees based on EZ Living Trust’s then-current compensation schedule. These are referral rewards, not commissions for legal or advisory services.
6.3 Recruitment of Other Partners
Partners may recruit other licensed professionals to join the Program. If approved, they may earn a referral bonus or residual override based on program structure.
6.4 No Guarantee of Compensation
Referral or override fees are not guaranteed and may change if the referred Partner moves to another hierarchy, terminates their participation, or if EZ Living Trust adjusts its compensation policies.
6.5 Tax Responsibility
Partners are responsible for reporting all compensation to tax authorities. EZ Living Trust may issue Form 1099 as required by U.S. tax law.
7.1 Authorized Use
EZ Living Trust grants Partners a limited, revocable license to use EZ Living Trust branding, approved marketing materials, and digital assets solely to promote the EZ Living Trust platform and services.

8.1 Ownership
All website content, questionnaires, guides, explainer videos, branding, software code, text, and graphics within the EZ Living Trust platform are the exclusive property of Strategic Choices Financial, Inc. DBA EZ Living Trust.
8.2 Prohibited Use
Partners may not reproduce, copy, distribute, reverse-engineer, or create derivative works of EZ Living Trust’s intellectual property, trade secrets, or proprietary materials.
8.3 Enforcement
EZ Living Trust reserves the right to pursue legal remedies or terminate participation immediately upon evidence of IP infringement, plagiarism, or unauthorized duplication.
Partners agree to protect all non-public information regarding clients, EZ Living Trust, and its systems. Sharing or misusing this information for competitive purposes is strictly prohibited.
10.1 Binding Arbitration
All disputes arising under these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles County, California.
10.2 No Jury or Class Actions
Both parties waive the right to a jury trial and agree not to participate in class or representative actions.
10.3 Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
EZ Living Trust shall not be liable for any indirect, consequential, or incidental damages arising from participation in the Partner Program. Total liability shall not exceed the amount of referral or override fees paid to the Partner in the preceding 12 months.
12.1 Termination by Either Party
Either party may terminate participation at any time, with or without cause, upon written notice.
12.2 Effect of Termination

Partners must cease use of all EZ Living Trust branding, materials, and intellectual property upon termination.
13.1 Entire Agreement
This document constitutes the full agreement between you and EZ Living Trust regarding your participation in the Partner and Affiliate Program.
13.2 Modifications
EZ Living Trust may update these Terms at any time by posting the revised version on its Partner Portal or notifying you by email.
13.3 Severability
If any provision is deemed invalid, the remaining sections remain in effect.
13.4 Force Majeure
EZ Living Trust is not liable for delays or performance failures caused by events beyond its reasonable control.
13.5 No Waiver
Failure to enforce any provision shall not constitute a waiver of future enforcement rights.
14.1 License Grant
EZ Living Trust (“Licensor”) grants Partners and authorized users (“Licensee”) a limited, non-exclusive, non-transferable, and revocable license to access and use the EZ Living Trust platform, software, and associated materials (collectively, the “Licensed Software”) solely for the purpose of referring clients and assisting them within the Partner Program.
14.2 Scope of Use
Licensee may use the Licensed Software only through the online Partner Portal or designated EZ Living Trust subdomain. The license does not permit installation, distribution, resale, sublicensing, reverse-engineering, or modification of any software, code, or documentation.
14.3 Intellectual Property Rights
All intellectual property rights in and to the Licensed Software, including but not limited to source code, algorithms, questionnaires, design, and trade secrets, remain the exclusive property of Strategic Choices Financial, Inc., DBA EZ Living Trust. No ownership rights are transferred under this Agreement.
14.4 Restrictions
Licensee shall not, directly or indirectly:
a. Copy, modify, or create derivative works of the Licensed Software;
b. Distribute, rent, lease, sell, or sublicense access to any part of the platform;
c. Circumvent or attempt to defeat security measures;
d. Use the software for any purpose that violates applicable law or third-party rights.
14.5 Confidentiality
Licensee agrees that all information contained in or derived from the Licensed Software, including technical data, functionality, or workflows, shall be treated as confidential and used solely for authorized business purposes.
14.6 Termination of License
This license automatically terminates upon Partner’s suspension, deactivation, or termination from the Program, or if EZ Living Trust reasonably believes that Licensee has violated any terms of this Agreement. Upon termination, Licensee must immediately cease all access and use of the Licensed Software.
14.7 Disclaimer of Warranties
The Licensed Software is provided “as is” without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
14.8 Limitation of Liability
EZ Living Trust shall not be liable for any loss, damage, or data corruption resulting from use of the Licensed Software. In no event shall EZ Living Trust’s total liability exceed the amount paid (if any) for access to the software within the preceding twelve (12) months.
14.9 Governing Law
This EULA is governed by the laws of the State of California, consistent with Section 10.3 of these Terms.
